Trust Establishment, Registration & Types
All trusts must be established by a written trust instrument and registered with the Trust Regulator. The four principal types recognized under the Law on Trust are:
• Commercial Trust – established for profit for the benefit of the trust contributor (e.g., pension, education, property-saving or employee-share schemes).
• Public Trust – established for the benefit of the Cambodian people (including development of banking and microfinance sectors).
• Social Trust – established for cultural, educational, humanitarian, religious or scientific purposes.
• Individual / Personal Trust – established for the benefit of the settlor or named beneficiaries.
We draft trust deeds, advise on the selection of licensed trustees, prepare registration applications (including the prescribed fees which vary by trust type and fund size), and manage post-registration amendments, change of trustee, or termination. Real-estate trusts (transfer of ownership or administration of immovable property to a licensed trustee) and escrow / retention arrangements for property transactions are particular areas of practical demand.
