Child & Spousal Maintenance
The Civil Code imposes obligations of maintenance between spouses and for the support of children. We advise on the quantification of child maintenance (taking into account the needs of the child and the means of each parent) and on spousal maintenance where one party has a legitimate claim following divorce or separation. We assist with negotiated maintenance agreements that can be submitted for court approval, and we represent clients in contested applications for the fixing, variation or enforcement of maintenance orders. Enforcement tools include court applications for payment orders and, where necessary, attachment of income or assets. Clear documentation of income, expenses and the child’s needs is essential to a successful outcome.
