Matrimonial Property & Asset Division
On divorce or separation, the division of property acquired during the marriage is a central issue under the Civil Code. Cambodian law distinguishes between personal property and common (marital) property; the latter is generally subject to equal division unless the parties have agreed otherwise or the court finds special circumstances. We assist clients in identifying and valuing the marital estate (including land, businesses, bank accounts and other assets), in negotiating property settlement agreements, and in litigating disputed division claims. Foreign-owned assets, QIP-related interests, and property held through companies or nominees require particular care. A well-prepared property schedule and clear evidence of contributions significantly improve the prospects of a fair and enforceable outcome.
