Where parents are unable to exercise parental authority, or where a minor or adult lacks capacity, the Civil Code provides for the appointment of a guardian. We advise on applications for guardianship of minors (including in cases of parental death, incapacity or unfitness) and on protective measures for adults who lack decision-making capacity. The court prioritizes the welfare of the person concerned and the suitability of the proposed guardian. We prepare the necessary applications, evidence and proposed care arrangements, and we represent parties in contested guardianship proceedings. Ongoing reporting and accountability obligations of guardians are also addressed.
